How we operate:

1. Legal services are performed according to the law and priced according to Decree Law # 1/09.07.2004 regarding the minimal attorney remuneration by following a strict confidentiality as well as data protection and information privacy policy.

The client will be informed about the pricing of the legal services from the beginning onwards as well as about the relative amount of any further charges and costs. In the case that the client is agreed upon the terms, a contract between the attorney and the client will be complied to allow and assure that the attorney can proceed with the legal representation of the client. An invoice will be issued consequently.

The client will receive information about the state of the case in a timely manner.

According to the legal framework, all correspondence and documents (in all forms such as electronic, paper, etc.) are confidential.

2. Appointment as an insolvency administrator is performed according to the Commerce Law by the court as an interim measure as a temporary or permanent liquidator during the stabilization proceedings with a decision by the court.

Appointment of the insolvency administrator can be done either by the debtor or the creditor in case that the conditions from the second subparagraph of Article 655 according to the Commerce Law have not been met. Consequently, the insolvency administrator declares this with a notary statement and provides their agreement in a written form.

The appointment of a permanent insolvency administrator needs to be put to a vote and elected by the creditors according to Article 655 (1) (2) of the Commerce Law.

The functions of the insolvency administrator are clearly stated by Article 658 of the Commerce Law, including representation of the company, controlling the company’s activity, keeping the trading papers as well as the company’s correspondence; investigating and confirming the company’s property; according to the conditions presented by the law, the insolvency administrator handles the termination or rescission of the contract where the debtor is an involved party; takes part in the company’s insolvency hearings and has the right to file cases on its behalf; collects the debts and files them in a delegated bank account; has the right to control and operate with the finances in the debtor’s bank accounts if this is necessary in order to protect and keep their property; investigates and confirms the debtor’s creditors; prepares a plan according to Article 696; performs actions connected to the termination of the involvement in given trading companies; monetizes the property corresponding to the insolvency; performs other legal actions set out by the law or by the court.

After familiarizing oneself with the insolvency case, given that there are grounds for forming a lawsuit, actions to file a statement according to Article 655 (2) of the Commercial Law as well as a written consent are filed before the court.

Ventseslava Stefanova is part of the working group regarding improvements of the legal framework of insolvency and the implementation of Directive (EU) 2019/ 1023 (in cooperation with the Ministry of Justice) as well as mentoring insolvency administrator trainings organized by Ernst & Young Global Limited.Additionally, she is a mentor at the annual trainings for insolvency administrators organized by the Ministry of Justices (Order #3/27.06.2005).
